City Council business meeting on June 28

Brookhaven, GA, June 27, 2023 – The Brookhaven City Council will conduct its next regularly scheduled business meeting Wednesday, June 28 at 7 p.m., at Brookhaven City Hall, 4362 Peachtree Road NE, in Brookhaven. While the meeting will be held in person, the public can participate in public hearings and public comment remotely via Zoom video conference.

Residents can submit public input by any of the following options:

The business meeting contains the following for City Council consideration:

  • Consideration of 2023 millage rates after the public hearings on June 13 at 7 p.m. and June 28 at 10:30 a.m. and 6:30 p.m.
    • FY 2023 millage rate for General Maintenance and Operations (General Fund) - 2.74 mils
    • FY 2023 millage rate for General Obligation Bonds - .49 mils
    • FY 2023 millage rate for Special Tax District - 6.450 mils
    • FY 2023 millage rate - LaVista Park Special District - 1.600 mils
    • FY 2023 millage rate for Special Service District - 4.000 mils

 A public hearing on the 2023 Brookhaven Community Development Block Grant Action Plan.

  • Consideration of a resolution adopting the Brookhaven 2023 Community Development Block Grant Action Plan.
  • A public hearing and consideration of LUP22-00007: Structure Properties, LLC to rezone the subject properties from C-1 (Local Commercial) and Rs-75 (Single Dwelling Detached) to Ns (Neighborhood Shopping) with concurrent variances to allow a neighborhood scale commercial development at 1348 Windsor Parkway, 3147 & 3153 Osborne Road, and 1153 Victoria Street.
  • A public hearing and consideration of TA23-08, an ordinance to amend Chapter 27, Section 27-402, PRO, Peachtree Road Overlay and Section 27-464, PR, Peachtree Road Districts.
  • A public hearing and consideration of LUP23-00004 by Thomas M. Clarke to rezone subject property from RS-75 (Single-Dwelling Detached 10,000 Sq. Ft.) to RS-50 (Single-Dwelling Detached 6,000 Sq. Ft.) with concurrent variances to allow for a Subdivision Plat at 1424 Sylvan Circle.
  • A public hearing and consideration of an ordinance to amend Chapter 27 Zoning Ordinance - revisions to the State Zoning Procedure Law - House Bill 1405 update.
  • A public hearing and consideration of LUP23-00005 by Marvin Laster to rezone from C-2 (Local Commercial) to RS-50 (Single-Dwelling Detached 6,000 Sq. Ft.) with concurrent variances to allow a new single-family residence at 1157 Victoria Street.
  • A public hearing and consideration of an ordinance to amend Chapter 27, Article VII Division 12, Section 27.722 - TA22-01: Donation Box Text amendment.
  • A public hearing and consideration of an ordinance to amend Chapter 27 (Special Purposes Districts).
  • A public hearing regarding LUP23-00009: rezoning Merry Hills/Toco Hills.
  • A first read and public hearing to annex property known as Merry Hills /Toco Hills.  A vote on this annexation is scheduled for the City Council meeting on July 25.
  • A public hearing and consideration of an ordinance to amend Chapter 27 Zoning Ordinance - Modifications to Land Use Requirements for the Buford Highway Overlay District.
  • A consent agenda which includes:
    • The minutes of the June 13, 2023, Work Session and Regular Meeting
  • An ordinance to amend the 2023 General Fund, Urban Redevelopment Agency Fund, Special Services District Fund, and the Vehicle Replacement Fund Budget to appropriate fund balances in the General Fund and Special Service District Fund and Appropriate Budget.
  • A resolution to approve the Guaranteed Maximum Price (GMP) amendment.
  • A resolution to approve Amendment #6 to the contract for Sizemore Group.
  • A resolution approving authorization to CMAR (McCarthy Barnsley JV) to award contracts for early release and design.
