Do I need a permit to construct a fence?

Yes, a permit is required to construct a fence.

Residential:  There is no fee for residential fences.  Permits shall be submitted through the Project Portal.  Fences enclosing pools and detention area may require additional reviews.  The Project Portal can be found here.

Commercial:  Commercial fences require a permit and review.  The fence permit shall be applied for through the project portal found here.

Do I need a permit for a sign (banner, wall sign, monument)?

Permanent signs (wall or monument) do require a permit. Regulation regarding sign can be found in the sign ordinance here.

Temporary signs (banners, stack signs, standard informational):

Banners - A permit is required. 

  • Banners shall not exceed 24 square feet in size.
  • Banners shall be allowed for a period not exceeding 14 days with no more than three such 14-day periods being permitted per calendar year per lot.
  • All banners must be maintained in good condition.

Standard Informational (stack signs):

A permit is not required. However, the follow regulations apply:

  • One sign per lot not to exceed 16 square feet in area, or up to four signs not to exceed an aggregate sign area of 16 square feet.
  • All standard informational signs shall be erected to a height not greater than six feet above ground level.

Can I get a waiver/variances to work outside of construction hours?

Please contact the Brookhaven Fire Marshal’s Office at 404-637-0500 for reporting possible fire violations. An inspection will be conducted to validate fire violation(s) by the Brookhaven Fire Marshal’s Office.

Can I remain anonymous when I report a fire violation?

Yes. However, there are some complaints that require the Fire Marshal’ Office to contact you for more specific information. We will never provide your information to anyone while investigating a fire safety concern.

May I notify the Brookhaven Fire Marshal’s Office for fire safety concerns for a single-family dwelling?

The Brookhaven Fire Marshal’s Office does not have jurisdiction in a single-family home and only conducts inspections and investigates complaints on commercial properties, which includes apartment buildings. What are the penalties of a court citation?

Penalties are as follows; however, fines are ultimately set by the Municipal Court Judge:

  • Fines ranging from $100 to $1,000 per violation, per day
  • Jail time - between 1 to 60 days maximum per violation, but not to exceed 180 days for all charges
  • Alternative compliance such as demolition, order to vacate, and\or clean and close the property
  • Community service

What can I do about my neighbor’s tree(s)?

The overall condition of trees and concerns raised by an adjacent property owner are a private civil matter.  The City recommends that the adjacent property owner send a formal letter with photographs of the trees documenting the matter by certified mail to the owner of record. Homeowners may find an ISA Arborist at https://www.treesaregood.org/findanarborist to assist with tree health, risk assessments and tree work.

How long is the plan review process?

The City aims to complete residential reviews in 5 business days and commercial reviews in 10 business days.  Multiple review cycles may be required.

When is a tree removal permit required?

A tree removal permit is required for removal of any tree 4 inches or more in Diameter Breast Height (DBH). Click here to apply for a permit.

How do I measure a tree's diameter at breast height (DBH)?

Tree diameter at breast height, or DBH, is a standard method of expressing the diameter of a tree's primary stem, or trunk, in inches. To find out a tree’s DBH using a standard household measuring tape, measure the circumference of the tree trunk at a height of 4.5 feet from the ground.  If the tree is on a slope, measure from the highest ground level.  Divide the circumference of the tree by 3.14 to come up with the DBH. Example: 62 inches/3.14 =19.74 inches DBH.
