Update, June 12: Georgia Gov. Brian Kemp issued new executive orders on June 11 that, among other items, lifts party sizes and number of patrons in restaurants, allows bars to serve up to 50 people, effective June 16, and allows live performance venues to open July 1. More details about this and other executive orders issued by Gov. Update, May 28:

Georgia Gov. Brian Kemp issued new executive orders on May 28 that, among other items, extends the Public Health State of Emergency through July 12. Other points include:

  • Gatherings are defined as groups of 25 or more persons and social distancing of 6 feet spacing is still required.
  • Populations at risk are still required to shelter in place, through June 12.
  • Restaurants are still limited to 10 patrons per 300 square feet of space, with additional restrictions on spacing.
  • Live performance venues remain closed, but bars and nightclubs are allowed to open.
  • Amateur sports leagues are authorized to resume operations and are required to comply with rules governing non-Critical Infrastructure organizations.

Update, May 12: 

As Georgia inches its way back to some degree of normalcy, Governor Brian Kemp signed a new executive order May 12 that allows, among other things, restaurants to serve 10 diners per 300 square feet instead of the current 500 feet. The order also increased the maximum number of people who can be seated together from six to 10.

This decision has led to more Atlanta restaurants to reopen for dine-in service. In April, in an effort to assist restaurants with responsible social distancing compliance, Brookhaven City leaders developed a Temporary Outdoor Restaurant Operations Permit which allows the use  of tents and parking lot areas for seating, where they might not otherwise be permitted by City code. The permits are being issued at no cost to the restaurants.  Under the permit, restaurants can utilize 10-foot by 10-foot tents in their parking lots to meet the spacing requirements for up to 90 days.

Additional steps taken in Kemp’s most recent executive order call for bars, nightclubs and live performance venues that expected to reopen May 13 to remain closed for now. Restrictions on other business operations also remain and Kemp said he would decide at the end of the month whether to loosen more restrictions.

Additional guidelines from Kemp’s executive order include:

  • Daytime summer camps can begin opening May 14 as long as they follow a list of 32 guidelines that include screening campers and employees for fevers and other signs of illness. Camp officials must enforcing social distancing, requiring parents to stay in their vehicles when dropping off and picking up their children provide regular cleanings, and provide sanitizers to campers and workers.
  • Shelter-in-place restrictions will remain in effect another month, through June 12, for those over 65, those who are medically fragile and those who reside in nursing homes or long-term care facilities.
  • Indoor movie theaters are required to have patrons sit at least six feet apart. Tape must be applied to floors at ticket counters and concession stands to enforce social distancing.
  • Childcare facilities that only allowed 10 people in one room can now have 20 people to address the shortage in daycare for parents and families that work. They all must follow 13 mandatory criteria, including social distancing, screening children and employees for illness and increased cleaning and disinfecting.
  • Workers at gyms and health fitness venues are also now required to screen patrons for fevers and illness, enforcing social distancing between equipment as well as enforcing wipe-downs of the equipment.
  • Retail businesses, including grocery stores, must limit capacity inside the store to 50% of fire capacity occupancy, or the equivalent of eight customers per 1,000 square feet.

Update, April 30: Georgia Gov. Brian Kemp issued an executive order that extends the State of Public Health Emergency to June 12, 2020. The Governor has extended the shelter in place directive for all nursing homes, assisted living facilities, hospice facilities, and the like through June 12. Additionally, he has directed anyone at heightened risk for complications from the disease to also shelter in place. No one subject to the continued shelter in place directive are supposed to receive visitors. All other Georgians are released from the April 2 Shelter in Place order as of April 30. Update, April 21: Georgia Gov. Brian Kemp issued a new executive order on April 20 that supersedes Brookhaven's (and all other municipalities') orders and ordinances as pertains to the spread of the COVID-19 virus.
